1. Structural Notice: Zero-Knowledge Limitations
Encbyt Technologies ("Encbyt", "we", "us", or "our") respects the intellectual property rights of artists, developers, and rights holders worldwide. This policy outlines our compliance mechanisms under the Digital Millennium Copyright Act (17 U.S.C. § 512) and international copyright protection frameworks.
Because Encbyt operates strictly on a Zero-Trust, Zero-Knowledge Architectural Model, rights holders must understand our mathematical and technical reality:
- Client-Side Cryptographic Execution: All files, file names, folder hierarchies, and media payloads are encrypted locally on user hardware using AES-256-GCM before transmission.
- Zero Plaintext Storage: Our servers receive, transport, and host only unreadable, scrambled binary ciphertext blocks. Encbyt engineers, system administrators, and automated indexing bots cannot search, inspect, view, or decrypt user files.
- Decryption Keys in URL Hash Fragments: When a user creates a public share link, the cryptographic decryption key is embedded solely within the URL hash fragment (`#`). Because web browsers do not transmit URL hash fragments to web servers in HTTP request headers, Encbyt servers never receive, log, or store the decryption key.
2. Submitting a Notice of Copyright Infringement
If you are a copyright owner, or an authorized representative acting on behalf of one, and you believe that a publicly accessible Encbyt sharing link infringes your copyrighted work, please submit a formal written notice containing all of the following elements:
- Identification of the Protected Work: A clear description of the copyrighted work claimed to have been infringed, including copyright registration numbers if applicable.
- Specific Public URL: The exact Encbyt public sharing URL (e.g.,
https://encbyt.in/share/...) pointing directly to the alleged infringing file. General statements without specific link identifiers cannot be acted upon. - Proof of Ownership or Authority: Documentation or a verifiable statement confirming that you are the copyright owner or legally authorized to act on their behalf.
- Good-Faith Statement: A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement Under Penalty of Perjury: A statement made under penalty of perjury that the information provided in your notification is accurate and that you are authorized to enforce the copyright.
- Contact Credentials: Your legal name, organization, physical mailing address, telephone number, official email address, and physical or electronic signature.
Submit formal notices directly to our designated copyright desk: [email protected] (cc: [email protected]).
3. Takedown Actions & Repeat Infringer Policy
Upon receipt of a complete and jurisdictionally valid notice meeting the requirements above:
- Expedited Endpoint Revocation: Our abuse operations desk investigates and acts upon verified notices within 24 to 48 business hours, immediately cutting off public access to the flagged link.
- Account Holder Notification: We notify the user who generated the public link regarding the takedown action and provide instructions for filing a counter-notification.
- Repeat Infringer Termination: Encbyt maintains a strict zero-tolerance repeat infringer policy. Accounts that repeatedly misuse our platform to distribute unauthorized copyrighted media will face immediate suspension, permanent account termination, and complete hardware storage sanitization.
4. Counter-Notification Procedure
If an account holder believes that a public link was disabled due to mistake, misidentification, or legitimate fair use, they may submit a formal Counter-Notification to our copyright desk:
- Mandatory Information: Full legal name, registered email address, physical address, telephone number, identification of the disabled URL, and a statement under penalty of perjury that the material was removed as a result of mistake or misidentification.
- Consent to Jurisdiction: A statement consenting to the jurisdiction of the competent courts in India and agreeing to accept service of process from the original complaining party.
- Statutory Timeline: Upon receiving a valid counter-notification, Encbyt provides a copy to the claimant. If the claimant does not notify us within ten (10) to fourteen (14) business days that they have filed a court action seeking an injunction, Encbyt may restore the disabled sharing endpoint.
