These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Encbyt Technologies ("Encbyt", "we", "us", or "our"). By creating an account, accessing encbyt.in, or utilizing our zero-knowledge storage vault, you agree to comply with and be bound by these Terms.
1. Grant of License & Scope of Permitted Use
Encbyt grants you a personal, revocable, non-exclusive, and non-transferable license to access and utilize our zero-knowledge cryptographic cloud platform subject to these Terms:
- Personal & Commercial Utility: You may utilize Encbyt for personal private archives, confidential documents, creative freelance assets, and legitimate commercial or enterprise workflows corresponding to your active subscription quota (ranging from 128 GB up to multi-terabyte dedicated tiers).
- Infrastructure Integrity Restrictions: You agree not to reverse engineer, decompile, disassemble, or attempt to derive the source code of our routing and infrastructure layers; bypass API rate limiters; interfere with network load balancing; or probe our storage clusters for unauthorized vulnerabilities.
2. The Zero-Knowledge Covenant & Sovereign Key Custody
Encbyt operates strictly on a verified Zero-Trust, Zero-Knowledge cryptographic framework. By using our service, you acknowledge and agree to the following technical and operational realities:
- Local Key Ownership: All encryption and decryption keys are derived locally within your browser using your master passphrase and client-side random salts. Encbyt does not hold, transmit, view, or manage your master password or private encryption keys.
- The 24-Word Recovery Protocol: During registration, your device generates a unique, deterministic 24-word recovery phrase. Account password resets can only be performed by submitting this valid 24-word recovery phrase inside the account recovery interface. Encbyt support personnel do not possess administrative access or database backdoors to reset credentials on your behalf.
- In-Session Phrase Regeneration: If you have active access to your vault using your valid master password, you may inspect or regenerate a fresh 24-word recovery phrase at any time inside
Account Settings → Cryptographic Security. Regenerating a phrase immediately invalidates any previously issued recovery seed. - Irreversible Loss Disclaimer: If you lose both your master password and your 24-word recovery phrase, your data is mathematically lost forever. Encbyt accepts absolute zero liability for data rendered permanently inaccessible due to lost credentials. We sell security, not an ordinary storage box—and security requires absolute personal custody over your cryptographic keys.
3. File Transfer Architecture, Pause/Resume & Capacity Ceilings
To preserve local hardware stability and ensure resilient data transfers:
- 5 GB Web File Limit: To prevent browser memory overflows and local processor lockups during client-side AES-256-GCM encryption, the web console enforces a maximum single file upload ceiling of five gigabytes (5 GB). You may store as many 5 GB files as your aggregate account quota permits. Standalone desktop and CLI sync clients for single files exceeding 5 GB are in active development. Bypassing client-side memory safety boundaries using unauthorized scripts or automated API injectors is strictly prohibited.
- Fault-Tolerant Pause & Resume: Encbyt provides client-side transfer tracking allowing file uploads and downloads to be paused and resumed without progress loss. You agree not to abuse state-preservation endpoints through automated resource flooding or by maintaining thousands of orphaned upload sessions designed to degrade server connection tables.
4. Evaluation Trial & Inactive Storage Lifecycle
We maintain clear data retention lifecycles to balance high-durability protection with physical hardware reclamation:
- 30-Day Free Evaluation: New accounts receive an unrestricted thirty (30) day evaluation trial with full platform features and zero automated billing obligations.
- Standby Dormant Holding Phase (90 Days): If a 30-day evaluation trial expires without subscription conversion, or if an active paid subscription lapses due to non-renewal, the account enters an inactive state. The associated encrypted data is transferred into an internal, isolated dormant preservation tier for ninety (90) days.
- Reactivation Rights: During this 90-day dormant window, your files remain fully encrypted and shielded from external networks. You may reactivate your vault at any time by selecting an active subscription tier, which immediately restores active access without data loss.
- Permanent Cryptographic Sanitization: If an inactive account is not reactivated within the ninety (90) day dormant preservation window, Encbyt reserves the absolute right to permanently and irreversibly purge all associated encrypted data blocks to reclaim physical hardware. Data purged under this policy cannot be recovered under any circumstance.
- Manual Erasure: When you manually delete a file within an active vault or empty your trash, the associated ciphertext blocks are flagged and purged immediately from active clusters.
5. Subscriptions, Billing, Renewals & 7-Day Refund Policy
- Advance Recurring Billing: Paid plans are billed in advance on a recurring monthly or annual schedule via authorized payment processors.
- 7-Day Money-Back Guarantee: We offer a full 7-day money-back guarantee for first-time paid subscribers. If you determine within seven (7) days of initial purchase that our cryptographic platform does not meet your requirements, email
[email protected]to receive a full refund. - Subsequent Renewals: Because dedicated storage allocations and outbound network channels are provisioned immediately upon transaction confirmation, subsequent recurring renewals are non-refundable. Please review our dedicated Refund & Cancellation Policy for full terms.
- Subscription Cancellation: You may cancel recurring billing at any time via your billing dashboard. Upon cancellation, your vault remains fully operational through the end of the paid billing cycle, after which it enters the standard 90-day dormant preservation lifecycle.
6. Acceptable Use Policy (Zero-Tolerance Misuse)
While Encbyt cannot inspect the contents of your encrypted data, we maintain a strict, zero-tolerance policy against infrastructure misuse. You warrant and agree that your account will not be utilized to:
- Distribute, host, propagate, or execute computer viruses, worms, trojans, ransomware, spyware, command-and-control payloads, or malicious scripts.
- Host, generate, or distribute public endpoints containing Child Sexual Abuse Material (CSAM), non-consensual exploitative imagery, or terror-related media.
- Infringe upon the valid copyrights, trademarks, patents, trade secrets, or intellectual property rights of any third party.
- Execute automated network scraping, distributed denial-of-service (DDoS) operations, brute-force attempts, or resource abuse designed to degrade infrastructure performance for other users.
Encbyt reserves the absolute right to immediately revoke public sharing privileges, disable accounts, and terminate service upon receiving credible notifications of statutory abuse, judicial orders, or intellectual property infringement.
8. Service Availability & Warranty Disclaimers
The Encbyt platform is provided strictly on an "AS IS" and "AS AVAILABLE" basis. Encbyt expressly disclaims all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
While our infrastructure is engineered for 99.9% durability across geographically redundant clusters, we do not warrant that:
- The service will be completely uninterrupted, timely, or error-free.
- Cryptographic client-side execution will remain fully functional on outdated, unsupported, or compromised browser environments.
- Stored data will remain invulnerable to losses arising from compromised local hardware, malware on your device, forgotten master passwords, or lost recovery phrases.
9. Limitation of Monetary Liability
To the maximum extent permitted by applicable law, in no event shall Encbyt Technologies, its founders, directors, employees, contractors, or infrastructure partners be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages—including loss of profits, loss of data, loss of goodwill, system downtime, business interruption, or financial loss—arising out of or related to the use of or inability to use our platform.
10. Governing Law & Judicial Jurisdiction
These Terms and any dispute, controversy, or claim arising out of or relating to your relationship with Encbyt shall be governed by, construed, and enforced in accordance with the substantive laws of India.
You irrevocably agree that any legal action, dispute, or proceeding arising out of or relating to these Terms or the platform shall be submitted to the exclusive jurisdiction of the competent courts located in Dist- Pali, Rajasthan, India.
